Service Agreement

Quick Budget: 24 hours; Small Job: 48 hours; Single Trade: 48–72 hours depending on sheet count; Full Commercial: quoted per job. All turnaround times are counted in business hours/days from receipt of complete drawings. Rush (+50%, subject to availability) cuts turnaround roughly in half; Quick Budget is about 8–12 business hours.
1. Provider
These services are provided by Visionary Tech Consulting LLC, an Oregon limited liability company, doing business as ProBids.construction ("ProBids.construction").
2. Services
ProBids.construction prepares the estimate deliverables for the selected package only from the drawings, specifications, addenda and information the client provides. Unless agreed in writing, services do not include site visits, design or engineering, code or permit review, collecting subcontractor or supplier quotes, bonds, or scheduling.
3. Estimates are preliminary
Estimates are opinions of probable cost based only on the drawings provided. They are not a bid, quote, guaranteed price, appraisal, or engineering, legal or financial advice. Actual costs will differ. Quick Budget is a rough order-of-magnitude range only.
4. Fees and payment
Payment is 100% up front: the full package fee, including any rush and white-label fees, is paid at checkout (or on the Full Commercial invoice) before work starts. After the estimate is approved, the client receives a watermarked preview and then the final package, including the editable workbook (quantities only). No further payment is due for the package. Refunds follow the Refunds section, except if ProBids.construction fails to deliver for reasons within its control. Rush service is +50% of the package fee. Addendum re-pricing is $150/hr. One revision round is included; additional rounds are $150/hr. Service is available for projects in all 50 states and Washington, DC.
5. Refunds
(1) Full refund if you cancel before work starts. (2) If we miss the delivery deadline, you get a full refund plus 50% off your next order. (3) No refund after delivery, but one free reprice within 30 days if your drawings change. (4) Full refund if the drawing set is unusable and we decline the job. Deadlines are measured from receipt of complete drawings, in business hours/days, per the published turnaround.
6. Missed-deadline credit
The 50% off applies to the next order’s package fee including add-ons, is issued as a single-use code, and expires 12 months after issue.
7. White-label
White-Label Branding is +$200 per order and is included with Full Commercial Estimate. White-Label No Credit is +$400 per order, or +$200 with Full Commercial Estimate. White-label fees are part of the up-front payment. The client must have the right to use any supplied logos or marks. ProBids.construction remains the preparer, and the license and confidentiality terms still apply.
8. Client responsibilities
The client must provide complete, current drawings; verify all quantities, scope and pricing before relying on them; and obtain their own subcontractor and supplier quotes. The client is responsible for their bid, price, markup and all licensing, bonding, wage and code obligations.
9. No guarantee of award or profitability
ProBids.construction does not guarantee a bid award or project profitability.
10. Confidentiality
Both sides must keep the other’s information confidential. Client drawings stay confidential; an NDA is available on request. ProBids.construction’s methods, unit prices, supplier information, labor rates and pricing data are confidential and are never disclosed or delivered.
11. License
After full payment, the client receives a non-exclusive, non-transferable license to use the deliverables for the single named project. Resale, reuse on other projects, reverse engineering and removing watermarks are not permitted.
12. Limitation of liability
To the extent the law allows, ProBids.construction’s total liability for any order is capped at the fee paid for that order. ProBids.construction is not liable for consequential, incidental, or lost-profit damages. Estimates are preliminary budgets based on the drawings provided, not guarantees or bids. The client is responsible for verifying quantities and pricing before bidding or contracting.
13. Cancellation
If the client cancels before work starts, the payment is refunded in full. After work starts, the Refunds section applies.
14. Governing law
These terms are governed by the laws of the State of Oregon. Any dispute will be resolved exclusively in the state or federal courts located in Oregon.
15. Acceptance
Checking the agreement box at checkout or signing an order form constitutes acceptance of this Service Agreement. Electronic acceptance is binding.
